For me, it's not a case of evil versus goody-goody.

When coming to this decision point, as a role-player, I have to ask myself two questions. The first is:

"How much reason does my character have to kill him?"

No matter what my origin,
1) he's framed me for his own crime
2) He sent an assassin after me
3) He put a price on my head
4) Depending on how well I liked Duncan and/or being a Grey Warden, I may also begrudge him Duncan's death.

5) In addition to that:

If I'm playing a human noble, Loghain's the one who unleashed Howe upon my family and thus is responsible for their deaths.

If I'm playing an elf, he was selling my people into slavery.

If I'm playing a mage, he was in cahoots with Uldred and thus could be at least partially blamed for what happened at the Circle Tower.

If I'm playing a dwarven noble, (if I understand it correctly, haven't played this yet) this would be the second time someone blamed me for his own crime and condemned me to death.

So... from just about every origin (except perhaps dwarven commoner?) there's some extra-special reason to kill Loghain.

But then we come to the second question, which is:

"How much does my character really actually CARE about any of these reasons?"

Now, if that answer is coming from a "goody-goody" as you put it, the answer is "quite a lot." The goody-goody is more invested in making Loghain account for his crimes.

If the answer is coming from an "evil" character, it may very well be "not very much" in which case, that character may be more inclined to let him live.

So I think the assumption that a "goody-goody" necessarily should be more merciful, or that it's OOC for a goody-goody NOT to be merciful, doesn't quite work. "Good" doesn't necessarily mean "forgiving."
